Welcome to Forktionary.com. These Terms and Conditions ("Terms") govern your access to and use of the Forktionary.com website and services (collectively, the "Service"), operated by Forktionary, LLC ("Forktionary", "we", "us", or "our").

1. Acceptance of Terms

By creating an account, accessing, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and our User Policy, which are incorporated herein by reference. If you do not agree with these Terms, you may not use the Service.

2. User Accounts

To access certain features of the Service, you must register for an account. You agree to:

  • Provide accurate, current, and complete information during the registration process.
  • Maintain the security of your password and accept all risks of unauthorized access to your account.
  • Promptly notify us if you discover or otherwise suspect any security breaches related to the Service.

You are solely responsible for all activities that occur under your account.

3. User-Generated Content ("User Content")

Our Service allows you to create, upload, post, and share content, including recipes, text, photos, reviews, and comments ("User Content").

  • License Grant: By making any User Content available through the Service, you grant to Forktionary a non-exclusive, perpetual, irrevocable, worldwide, royalty-free, transferable license, with the right to sublicense, to use, copy, modify, create derivative works based upon, distribute, publicly display, and publicly perform your User Content in connection with operating and providing the Service.
  • Responsibility: You are solely responsible for all your User Content. You represent and warrant that you own all your User Content or you have all rights that are necessary to grant us the license rights in your User Content under these Terms.
  • AI-Generated Content Policy: If you use artificial intelligence (AI) tools to create or assist in the creation of User Content, you must disclose this fact where prompted or by using an appropriate tag. You are solely responsible for reviewing, editing, and verifying the accuracy, safety, and originality of any AI-assisted content. You warrant that your use of such tools and the resulting content does not infringe on any third-party rights. Forktionary treats AI-assisted content as your own User Content for which you are fully liable.

4. Forktionary's Intellectual Property and Content ("Forktionary Content")

All rights, title, and interest in and to the Service and its content, features, and functionality, excluding User Content, are and will remain the exclusive property of Forktionary and its licensors ("Forktionary Content"). This includes, but is not limited to, all software, text, displays, recipes, images, video, and audio created or published by Forktionary, and the design, selection, and arrangement thereof. While Forktionary owns or licenses all Forktionary Content, it is provided to you subject to the same disclaimers and limitations as all other content on the Service.

5. Prohibited Conduct

You agree not to do any of the following:

  • Post, upload, or distribute any User Content that is unlawful, defamatory, libelous, inaccurate, or that a reasonable person could deem to be objectionable, profane, indecent, pornographic, harassing, threatening, hateful, or otherwise inappropriate.
  • Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity.
  • Scrape, spider, use a robot, or use other automated means of any kind to access the Service.
  • Violate any applicable local, state, national, or international law.

6. Disclaimer of Warranties

THE SERVICE AND ALL CONTENT THEREIN (INCLUDING BOTH USER CONTENT AND FORKTIONARY CONTENT) ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTY OF ANY KIND. WITHOUT LIMITING THE FOREGOING, WE EXPLICITLY DISCLAIM ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, QUIET ENJOYMENT, OR NON-INFRINGEMENT.

WE MAKE NO WARRANTY THAT ANY RECIPES OR OTHER CONTENT PROVIDED THROUGH THE SERVICE WILL BE ACCURATE, RELIABLE, OR SAFE. THIS DISCLAIMER APPLIES FULLY AND EXPLICITLY TO ANY CONTENT THAT IS CREATED OR PUBLISHED BY FORKTIONARY, INCLUDING ANY CONTENT THAT IS CREATED OR ASSISTED BY ARTIFICIAL INTELLIGENCE.

7. Health and Safety Disclaimer

The Service is an informational resource and is not a provider of professional culinary, nutritional, or safety advice. You acknowledge that you follow any recipe or advice from the Service, regardless of whether it is User Content or Forktionary Content, at your own risk. Forktionary is not liable for any outcome related to the preparation of food, including but not limited to food-borne illness, allergic reactions, property damage, personal injury, or the success or failure of a recipe. You are responsible for ensuring your own food safety and for knowing your own dietary restrictions and allergies.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL FORKTIONARY, ITS AFFILIATES, AGENTS, DIRECTORS, OR EMPLOYEES BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, THAT RESULT FROM THE USE OF, OR INABILITY TO USE, THIS SERVICE OR ANY CONTENT THEREIN.

9. Indemnification

You agree to defend, indemnify, and hold harmless Forktionary and its officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from: (i) your use of and access to the Service; (ii) your violation of any term of these Terms; (iii) your User Content, including any AI-generated content; or (iv) your violation of any third-party right, including without limitation any copyright, property, or privacy right.

10. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including without limitation a breach of the Terms.

11. Governing Law & Dispute Resolution

  • Governing Law: These Terms shall be governed by the laws of the State of Delaware, without regard to its conflict of law provisions.
  • Dispute Resolution: You agree that any dispute arising out of or relating to these Terms or the use of the Service will be resolved by binding arbitration.
  • Class Action Waiver: You waive any right to participate in a class-action lawsuit or class-wide arbitration.
